Effective Oct. 1, 2023, OEA has introduced another option for filing Petitions for Appeal and Petitions for Review.

Petitions for Review

Any party to the proceeding may serve and file a Petition for Review of an Initial Decision with the Board within thirty-five (35) calendar days of issuance by an administrative judge. The Petition for Review shall set forth objections to the Initial Decision supported by reference to the record.  The Board may grant or deny the Petition for Review.  The Board’s decision shall be a written Opinion and Order.

An employee or agency seeking further review may appeal the Board’s decision to the Superior Court of the District of Columbia in accordance with DC Official Code § 1-606.03 and any applicable court rules.
