Notice of Final Rulemaking

The Chairperson of the Office of Employee Appeals (OEA) in accordance with 602 of the District of Columbia Government Comprehensive Merit Personnel Act of 1978, effective March 3, 1978, codified in DC Code 1-606.2(5) hereby gives notice that final rulemaking action was taken to adopt Sections 600 through 636 of Chapter 6 of Title 6 DCMR. These rules replace Chapter 6 in its entirety. The central purpose of these rules is to:

  • make the rules consistent with the recently passed Omnibus Personnel Reform Amendment Act of 1998;
  • streamline OEA litigation procedures in order to facilitate backlog reduction without compromising the due process rights of the parties; and
  • clarify the rules to present guidelines for adjudication before the Office.

The notice of proposed rulemaking was published at 46 DCR 4527 (May 21, 1999). Comments were received and considered; however, only non-substantive, editorial and clarifying changes were made to the rules as published under the notice of proposed rulemaking. These changes do not alter the intent, meaning, or application of the rules as published under the notice of proposed rulemaking. Final rulemaking action was taken on November 2, 1999.
